Governor's grant therefore may be defined as the conferment of a right in writing to a person usually under the seal of government. It is a registrable formal document before the issuance of the *certificate of occupany.* The Governor of a state is empowered under _Section 5 of the Land Use Act to grant a statutory right of occupancy to any person and all purposes_.
However a distinction must be made between the *docment of grant from the governor* of the state, from the state's subsequent *issuance of certificate of occupancy*. The former confers an assurance of interest, while the latter confers indefeasibility of interest granted. (Indefeasible meaning: A right or title in property that cannot be made void, defeated or canceled by any past event, error or omission in the title.) The *two* must be obtained.
